Oh boy. It appeared this last chapter had been written on the book of CM Punk punching a fan during a live episode of Monday Night Raw but it appears we may have to reopen it.

The latest -- and likely final -- update to the story of CM Punk punching a fan while he was in the stands during WWE Monday Night Raw in Sacramento, California, is that the Sheriff's Department will not be launching an investigation into the matter.
From Laura Cole, who has been outstanding reporting on the situation.
"Just got an update from the Sacramento County Sheriff's Department about the alleged incident involving @CMPunk. ... The Sheriff's Department says at this point the fan does not want to proceed any further and there is no evidence that a crime occurred. ... The Sheriff's Department also says the video is not part of the investigation because there is no investigation."
And there you have it. The fan who got hit won't be going after anyone and Punk has now apologized for the entire incident.
I think we can officially close the book on this one, Cagesiders.

It's now been a full 24 hours since CM Punk entered the stands in Sacramento, California, during the Oct. 8, 2012, episode of WWE Monday Night Raw and got into an altercation with several fans, ultimately punching one of them multiple times.
We've broken down the video tape, heard from one of the guys who was there, printed the statement from WWE, and now it's time to hear straight from the man himself.
WWE.com released a story with comments from Punk:
"I think the whole situation sucks. It's an unfortunate and isolated incident. I was up in the stands, surrounded. Somebody said, ‘let's push him down the stairs.' I got hit in the ribs three times. I was getting shoved and I was getting punched...Then I started getting tagged in the back of the head. Unfortunately, I lashed out in the heat of the moment and I apologize. I'm really just glad nobody was hurt."
Well, according to reports, apparently the man he hit is dealing with knee pain but there hasn't been any update there nor has there been any word on whether or not police are going to launch an investigation.
At this point, it seems unlikely and now that Punk has come out and apologized himself, it's probably time for everyone to move on.

Early this morning, a man named Dario Teyes took to Twitter in an attempt to seemingly take credit for the CM Punk fan punching situation at Monday Night Raw last night (Oct. 8, 2012) in Sacramento.
But let's try to clarify this.
The man standing to Punk's immediate right in this picture is Teyes:

Upon seeing himself on Cageside Seats, he linked to our story with the above picture and proceeded to brag about touching Punk, and how he "punched his kidney and slapped his back hella hard."
He also all but takes credit for Punk lashing out and striking a fan who was putting on sun glasses, and says that guy will be a millionaire now thanks to him.
But a close look at the video reveals that Teyes, though he definitely played a part in the incident, is not the one who slapped Punk in the back of the head and caused him to turn around and sock the fan in the sunglasses, who has since filed a police report and later stated he's now suffering from knee pain.
That honor goes to a random white man who can be seen flipping Punk off and then slapping him before slinking back behind the guy putting sunglasses on.

So, to be clear, Teyes certainly isn't innocent in all this, and his being a braggart on Twitter -- which now includes calling Punk a bitch and challenging him to a "one-on-one" fight or match or whatever -- is ridiculous, but he does not appear to be the straw that broke Punk's back.

Well, this is an interesting development.
In the same story from TMZ.com with WWE's statement involving the incident with CM Punk punching a fan at Monday Night Raw in Sacramento, California, they've got word from police that the man who Punk blasted contacted police after his initial report.
Because of knee pain. Seriously.
The victim met with police shortly after the incident ... and a rep for the Sacramento County Sheriff's Dept. tells us the man didn't appear to have any major injuries that required medical attention.
But later that night, the victim re-contacted police ... and said he had developed pain in his knees.
Cops say officers took the victim's statement and are determining whether to conduct a full investigation into the matter.
Well that's quite convenient, although it's always safe to err on the side of caution. Perhaps the man fell backwards after getting socked and once the initial shock of the incident wore off, he realized his knees were hurt.
But are you buying it, Cagesiders? Or are you calling hogwash?

Look what I've found on Twitter: Dario Teyes, a reader of ours I'm afraid, brags about being the fan that caused CM Punk to lamp an innocent bystander. He admits to punching Punk in the kidneys and slapping his back hard, which set the balls in motion for this unfortunate turn of events.

Last night, WWE Champion CM Punk made an example out of a fan on Raw, striking a seemingly innocent fan after being rattled by an anxious crowd. This video of TNA World Heavyweight Champion Austin Aries' encounter with a fan during his time in Ring of Honor shows that a human act in a time of pressure is not the most ludicrous idea.

Well, this close up video of the situation when CM Punk ran up into the stands at Monday Night Raw in Sacramento, California, shows exactly why CM Punk reacted the way he did.
He was pushed twice and the fan he punched hit Punk in the back of the head just before Punk turned and swung on him. But was the fan intending to hit him?
Judge for yourself:
That seems like it's clear Punk is simply retaliating to getting hit multiple times.
But does that make it okay?
UPDATE: After a closer viewing with my Cageside colleague June M. Williams, it seems obvious the fan in the sunglasses did hit Punk but he was not intending to do so and instead was actually pushed into Punk by a man standing behind him.
If you look closely (and I'm sure you have), a man actually pushes his way up to Punk's back, directly behind the man with the sunglasses, and shoves Punk before flipping him off and then smacking him in the back of the head. Punk, mistakenly thinking it was the man in the sunglasses, retaliates on the wrong man.
To be clear, the title of this post is not meant to imply that the man in the sunglasses hit Punk, just that Punk was shoved twice and hit in the head before punching the fan. That is all. Sorry for any confusion.

According to Laura Cole, a reporter with CBS 13 who was at Monday Night Raw last night (Oct. 8, 2012) in Sacramento, California, the fan punched by CM Punk in the crowd has filed a police report.
From her Twitter:
"Just talked to the fan that says he was hit by @cmpunk. He says he never hit Punk. ... This fan says his face is a little warm after he says @cmpunk hit him. He also says Punk broke his glasses. ... The fan is still filling out a report with law enforcement. ... Getting questions about whether the fan I talked to actually hit @cmpunk. All I can do is report what the fan told me."

There have been multiple reports from fans online, including a fan right here at Cageside Seats, that have said the fan struck Punk first and the WWE champion retaliated.
